Welcome to QueryDial! These Terms & Conditions (“Terms”) govern your use of the QueryDial mobile application (“App”) developed by Yuhao Zhang, residing in Scotland, UK (“Developer”). By downloading or using the App, you agree to be bound by these Terms. If you do not agree to all the Terms, you may not download or use the App.

Description of the App

QueryDial allows you to create search engine profiles and assign shortcut phrases for them. You can then use these shortcuts to search the web directly in Safari using the provided extension popup or by typing them in Safari’s address bar.

User Conduct

You agree not to:

1. Use the App for any unlawful or fraudulent purposes.
2. Copy, modify, adapt, or create derivative works of the App or its Content.
3. Interfere with, disrupt, or overload the App or its underlying infrastructure.
4. Attempt to gain unauthorized access to the App or any associated systems or networks.

Intellectual Property Rights

All rights, title, and interest in and to the App, including its Content and any associated intellectual property rights, are the exclusive property of the Developer and its licensors. You may not reproduce, distribute, or create derivative works of the App or its Content without the express written permission of the Developer.

Access to Features

Version 1.2.0 and earlier

Users who purchased the App before version 1.2.1 will have access to all features, including use unlimited number search engines and shortcuts in Safari.

Version 1.2.1 and later

Free users will be limited to using the top five search engines added to their “Fallbacks” list within the App. To use any search engines in your Library in Safari (without the need to set them as Fallbacks), users can purchase an “Unlimited Pass” through one of two options:

• Lifetime Access: This is a one-time in-app purchase that grants permanent access to any search engines in your Library in Safari.
• Annual Subscription: This is a yearly auto-renewing subscription plan that offers two months of free trial followed by a recurring annual fee charged to your App Store account payment method.

In-App Purchases and Subscriptions

In-app purchases and subscriptions are processed through the App Store. You can cancel your subscription or request a refund for in-app purchases through your App Store account settings.

Reliance on Third-Party Services

QueryDial relies on functionalities provided by the Safari browser offered by Apple Inc. The Developer is not responsible for any issues or limitations inherent to the Safari browser itself, which may affect the functionality of QueryDial.

User Responsibility for Compatibility

Users are responsible for ensuring their devices meet the compatibility requirements for QueryDial. The Developer is not liable for any problems arising from user devices not being compatible with the App.

Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland, UK.

Changes to the Terms

The Developer reserves the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on the App Store. Your continued use of the App after the posting of any revised Terms means you accept and agree to the changes.

Entire Agreement

These Terms constitute the entire agreement between you and the Developer regarding your use of the App.
